By using the DriveLive, you must accept and abide by the Terms and Conditions. If you do not accept the Terms and Conditions, you are not permitted to use the 'DriveLive Service' and you must refrain from using it and our Website and App.
DriveLive Service means a booking of a DriveLive by using our webforms to book a scheduled test drive to an address and undertake the free test drive.
DriveLive reserves the right to make changes to these Terms and Conditions which will be effective once they are published on this site. You should revisit this area of the Drivelive.co.nz Website and App regularly to check the Terms and Conditions.
You are responsible for all equipment and software used to access the DriveLive Website and App.
DriveLive gives no undertakings, representations or warranties in relation to the Cars and sales in relation to Cars listed on the DriveLive Website and App.
DriveLive excludes all liabilities (including in contract, for negligence or otherwise) for any loss, damage (whether direct or consequential), costs or expenses that may result from your use of the DriveLive Website and App.
You must not use the DriveLive Website and App directly or indirectly for any activity which breaches any laws, infringes a third party's rights, is unlawful, or breaches the Terms and Conditions
DriveLive gives no undertakings, representations or warranties in relation to the items sold or marketed on all DriveLive entities and marketing.
Dealers
In addition to the terms under 'DriveLive Dealer Agreement', each 'DriveLive Service’ is subject to the following additional terms when you agree to place and run a DriveLive and DriveLive Service on this basis:
All DriveLive and DriveLive Service are, from September 2020 subject to fees associated with leads generated through the DriveLive Website, App and marketing which included ads, SEO and social media marketing. A “Lead and Success Fee” is defined as an end user submitting a query to the DriveLive Website which comprises not less than the end user’s name, email and/or phone number & a nominated vehicle of interest. At the end of each calendar month DriveLive will send the Dealer Report of leads generated from the listings and marketing associated to that Dealer. From this report, DriveLive will invoice the Dealer for leads generated on a single, consolidated electronic invoice, in a form as specified by s 24 of the GST Act. Payment shall be subject to any tax or other deduction or withholding as is required by law.
Payment will be made to DriveLive for all tax invoices no less than 30 days following the date of invoice, unless otherwise agreed.
Fees associated with listings may include an initial fee to list, ancillary optional fees to enhance listings, and/or fees associated with the number of leads generated by the listing.
All fees are subject to change at DriveLive’s discretion.
Buyers
In addition a "DriveLive Buyer" are subject to the following additional terms when you agree to Test Drive with DriveLive on this basis:
All Buyers who go directly to the Dealership and buy, Finance or Subscribe to a Car from the Dealership or related party, from which was listed as the DriveLive Dealership is subject to pay DriveLive the “Success Fee” for the Car or any Car that is purchased within 12 months of taking the DriveLive. The Dealership is also a party to the debt and therefore subject to pay the Success Fee and invoice the customer directly.
